Starting January 2015, Express entry is the new system for selecting the skilled workers in Canada. Express entry is an electronic process to submit the application and there are three step program:
Making virtual profile for express entry and Job Bank Canada.

  • Your selection with be depend on many factors. You will be invited to apply if you fall under one of the categories.
  • Candidates with highest scores.
  • A job offer supported by Labour Market impact assessment.
  • A nomination from a Canadian province or territory.
  • Submit the application for PR once the candidate received the Invitation to Apply (ITA) from CIC.

Express Entry system is highly competitive Immigration process where you are competing against everyone in the pool and express entry profile is valid for 1 year only. Canadian Experience Class (CEC):

Canadian experience class is a program which enables the students or temporary foreign workers to apply for the Permanent residence. Since January 1, 2015 Canadian experience class is a part of Express entry. As a consequence students now have to compete with big pool of candidates.

The minimum requirements for being eligible to this category are as follows:

  • Atleast 12 months of skilled worker experience in Canada in last 3 years. (Experience earned during the study period doesn't count).
  • Demonstrate the language proficiency (speaking, reading, writing and listening) through standardized testing system
  • an to live outside the province of Quebec

There are many technicalities and details in the Canadian experience class application. A small mistake in assessment of the Express entry profile will make the candidate ineligible for a year.

Federal Skilled Worker Program:

Since January 1, 2015 Federal skilled worker program is a part of Express Entry. The major changes in this category being the elimination of eligible occupation list and cap linked to each occupation.

To be able to apply in FSW program, candidates must meet the following minimum requirements:

Atleast 1 year of continuous full time work (30 hours per week) continuous full-time or an equal amount in part-time.

  • The work experience gained should be through a paid job (Volunteer work, unpaid internship doesn't count.)
  • Experience should be gained in past 10 years and should be in skill levels O, A or B of 2011 (National Occupational Classification (NOC).
  • Demonstrate the language proficiency (speaking, reading, writing and listening) through standardized testing system (Minimum CLB 7 in each module)
  • Must have a Canadian sarondary or post-secondary certificate, diploma or degree or a foreign credential equivalent to Canadian secondary or post-secondary certificate, diploma or degree (An educational assessment report (ECA) must be received from an approved agency).

If you meet all the above selection factors mentioned above, you will then be assessed based on the six selection factors. Each selection factor carry certain points and totalling 100 points altogether. You would need to score 67 points out of 100 in order to qualify for the Skilled worker class. The six selection factors and their relative points are as follows :

  • Language Skill  :  Maximum 28 Points
  • Education  :  Maximum 25 Points
  • Experience  :  Maximun 15 Points
  • Age  :  Maximum 12 Points
  • Arranged Employment in Canada  :  Maximum 10 Points

Federal Skilled Trade Program:

Since January 1, 2015 Federal skilled trades program is a part of Express Entry. This stream is for people who wants to become permanent residents based on being qualify in a skilled trade.
Following are the minimum requirements for the skilled trades program:
At least two years of full-time work experience in a skilled trade within the five years before you apply.

  • Job requirements at previous skilled trade work experience must be as set out in the National Occupational Classification (NOC)
  • Have an offer of full-time employment for a total period of at least one year or a certificate of qualification in that skilled trade issued by a Canadian provincial or territorial authority.

Canada has variety of Provincial Nominee programs running that are independent of the Federal requirements in determining the kind of skills needed in different provinces. This is an additional route to permanent residence for applicants coming from different background.

Family Sponsorship

Canada passionately believes towards reunification of family members and there are sponsorship programs under which the sponsor who is a permanent resident or citizen can sponsor their immediate family members such as spouse, dependent child. Also, there are programs that enable a permanent resident or citizen of Canada to sponsor his or her Parents or grandparents.

There are also additional options to sponsor some relatives. Please note that different options have variety of eligibility criteria to be met for successfully being a sponsor or a principal applicant.

Parents Sponsorship

Canada is successfully running famous Parents and Grandparents program via which Canadian citizen or permanent residents of Canada can sponsor their parents or Grandparents to become permanent resident of Canada. Under this program, there is flexibility where the spouse of the principal sponsor can become co-sponsor so the required minimum income threshold can be met to become eligible as a sponsor. The principal applicants are currently chosen via lottery under this program.

Spousal Sponsorship

Canadian Citizens or permanent resident of Canada who are eligible sponsors can sponsor spouse, common law or conjugal partner and dependent children for permanent residence in Canada. There are some minimum eligible requirements that sponsor need to meet in addition to proving the genuineness of relationship. The sponsor needs to be of minimum 18 years of age and be legally married to successfully sponsor his or her spouse. If the couple is not legally married but are under common law, then they need to be in relationship for more than 12 months.

Employers in Canada who are willing to hire potential foreign workers can legally do so by applying for Labour Market Impact Assessment. An application for LMIA involves major documentation related to employer and the justification of proving that the vacancy and need for foreign workers is truthful and necessary for the employer. The LMIA is a complex process that can be well taken care of by a professional.

The LMIA can be of different nature such as for TFWP, Dual Intent, Express Entry for PR purposes.

An approved LMIA is an important document that enable temporary foreign workers to apply for work permit.
